Please review the following provisions before using “photo81” (the “Service”), an AI image generation and editing service provided by Beyond AI Co., Ltd. (the “Company”).
Article 1 (Quality and Accuracy of Generated Images)
The Service uses generative AI to generate and edit images.
Due to the nature of AI, generated results are not guaranteed to fully match users’ intentions or instructions.
Unintended changes or unnatural depictions may occur in faces, expressions, poses, hands and fingers, clothing, products, backgrounds, text, logos, and other elements.
Results of image upscaling and localized editing may also vary depending on the quality of the original image and the capabilities of the AI model.
The Company does not guarantee the accuracy, completeness, fitness for a particular purpose, or faithful reproduction of products or individuals in generated images.
Article 2 (Copyright, Portrait Rights, and Third-Party Rights)
Users shall confirm that they hold the necessary rights or permissions to use any images, photographs, logos, product designs, likenesses of individuals, or other materials uploaded to the Service.
In particular, when swapping the faces of real individuals, generating images resembling public figures, or using images containing third-party copyrighted works or trademarks, users must take care not to infringe copyrights, portrait rights, rights of publicity, trademark rights, or any other third-party rights.
The Company does not guarantee that images generated using the Service will be free from infringement of third-party rights.
Article 3 (Use of AI Talent and Digital Humans)
AI talent and digital humans generated using the Service do not necessarily represent real individuals.
Generated individuals may coincidentally resemble real individuals.
When using generated images of individuals in advertisements, on social media, on e-commerce websites, or in other media, users shall conduct appropriate checks to avoid infringing third-party rights or misleading consumers.
Article 4 (Commercial Use of Product Images and Advertising Photographs)
Images generated using the Service may be used for commercial purposes, subject to the Company’s Terms of Service and the applicable terms of the AI model providers.
However, permission for commercial use does not guarantee that copyright subsists in the generated images, that users acquire exclusive rights, or that the images do not infringe third-party rights.
In particular, generated images of products such as apparel, bags, accessories, and cosmetics may differ from the actual products in color, shape, material, pattern, logo, apparent size, or other details.
Users must verify the accuracy of product information and generated images before publishing them on e-commerce websites or in advertising media.
Article 5 (AI Models and External Services)
The Service may use generative AI models, APIs, cloud services, and other services provided by third parties.
Changes to specifications, discontinuation, outages, usage restrictions, or other circumstances affecting these external services may render some or all image generation and editing functions unavailable.
Updates to AI models may also affect generation speed, image quality, generated results, and other aspects of the Service.
The Company does not guarantee continuous, uninterrupted provision of the Service or the flawless operation of all functions.
Article 6 (Storage and Management of Generated Images)
Users should maintain their own backups of generated images and uploaded materials as necessary.
Images and data may become unavailable due to system failures, communication failures, expiration of retention periods, account deletion, or other reasons.
The Company does not guarantee permanent storage of all generated images or uploaded data.
Article 7 (Consumption of Credits and Tokens)
The Service consumes a specified number of credits or tokens depending on the functions, AI models, image dimensions, resolution, number of images generated, and other factors.
As a general rule, the specified number of tokens will be consumed for generation processes that complete successfully, even if the results do not meet the user’s expectations regarding quality or content.
However, system failures, incorrect charges, processing failures, and similar issues will be handled in accordance with the Company’s Terms of Service and its provisions concerning refunds and token returns.
Article 8 (Prohibited Uses)
Users must not use the Service for purposes that violate applicable laws, public order and morals, or the Company’s Terms of Service.
Use of the Service for infringement of third-party rights, impersonation, fraud, false advertising, defamation, creation of illegal content, or other inappropriate purposes is prohibited.
If the Company identifies use that violates the Terms of Service, it may take necessary measures in accordance with those terms.
Article 9 (Liability for Damages)
To the extent permitted by law, the Company makes no warranties regarding the accuracy, safety, completeness, continuity, or fitness for a particular purpose of the Service.
If damages arise in connection with the use of the Service, the Company shall be liable in accordance with applicable laws and the Terms of Service.
Nothing in this Article exempts the Company from liability or limits its liability where such exemption or limitation is prohibited under the Japanese Consumer Contract Act or other mandatory provisions of applicable law.
Article 10 (Changes to This Disclaimer)
The Company may amend this Disclaimer in response to changes in laws, changes to the Service, or other circumstances requiring such amendments.
When making amendments, the Company will provide the required notices and follow other necessary procedures in accordance with applicable laws and the Terms of Service.
